Azerbaijan Temporary Residence Permit (TRP or TRC) through Real Estate

Foreigners and stateless persons who want to temporarily live in Azerbaijan must obtain a relevant permit for this. Thus, they must obtain a Temporary Residence Permit (TRP or TRC) in Azerbaijan. One of the grounds for obtaining a Temporary Residence Permit (TRP or TRC) in Azerbaijan for foreigners is that they own real estate. To obtain a Temporary Residence Permit (TRP or TRC) in Azerbaijan, foreigners may purchase an apartment or commercial real estate.

I. Legal basis for obtaining a Temporary Residence Permit (TRP or TRC) in Azerbaijan through real estate (property).

According to the Migration Code, there are two ways to obtain a Temporary Residence Permit through Real Estate in Azerbaijan:

  • If you own real estate in Azerbaijan worth at least AZN 100,000, you can get a Temporary Residence Permit (TRP or TRC);
  • If you invest at least AZN 500,000 in Azerbaijan, you can get a Temporary Residence Permit (TRP or TRC).

As we mentioned, if you own real estate worth AZN 100,000 in Azerbaijan, you can get a Temporary Residence Permit (TRP or TRC). Please note that it does not matter if the real estate you own is residential or non-residential. Thus, if you own an apartment worth at least AZN 100,000 in Azerbaijan, you can get a Temporary Residence Permit (TRP or TRC). Also, if you own commercial real estate that meets the same requirements. Therefore, the duration of Temporary Residence Permits (TRP or TRC) is usually 1 year for the first applications. Let us add that if the same grounds exist, its duration can be extended for 2 years in your next application.

Another basis for obtaining a Temporary Residence Permit (TRP or TRC) is that you own a non-residential property in Azerbaijan worth at least AZN 500,000. On this basis, the duration of the Temporary Residence Permit (TRP or TRC) in Azerbaijan is usually 3 years. Unlike the first case, in this case the real estate in your own must be non-residential.

II. How can foreigners (stateless persons) buy real estate in Azerbaijan?

The process of buying real estate for foreigners (also for stateless persons) in Azerbaijan is quite simple. Just like in your home country, you must first find the residential (apartment) or non-residential property you want to buy. You can do it yourself or through your representative. You can also entrust the task of finding the property you want to buy to professional local Real Estate Companies. After you find the property you want to buy, you sign a contract in notary office with the current owner. After that, you pay the value of the property to the seller through the bank. In a few days, you will receive an extract from the registry confirming that the property is in your possession. In any case, we recommend that you do not hesitate to seek the services of lawyers regarding this process.

III. What to do to obtain a Temporary Residence Permit (TRP or TRC) in Azerbaijan after buying real estate?

Let’s say that you bought the real estate you wanted in Azerbaijan and you already own it. What to do now to get a Temporary Residence Permit (TRP or TRC) in Azerbaijan? You just need to apply to the State Migration Service after collecting the required documents.

In order to apply you must submit the following documents:
  • A document confirming the ownership of the real estate (apartment or non-residential);
  • A document confirming the current market value of real estate (apartment or non-residential);
  • Copy of your passport;
  • Medical certificate confirming that you are not a carrier of dangerous infectious diseases;
  • 2 3×4 size Photos;
  • Copy of the document confirming your right to stay and live in the country.

On the same basis (real estate) and for the same period, your family members also get a Temporary Residence Permit (TRP or TRC) in Azerbaijan. When we say your family members, we mean your spouse, children under 18 years of age. If your parents are over 65, it is possible to get a Temporary Residence Permit for them as well.
