Legalization of the documents in Azerbaijan

Documents issued in the territory of one country and having legal force can be used in the territory of another country after being duly formalized. Currently, there are two types of such formalization: issuance of an apostille and consular legalization.

Apostille certifies the authenticity of the signature of the person who signed the document, the part in which this person acted and, if necessary, the authenticity of the seal or stamp affixed to the document.

Consular legalization consists of determining and verifying the authenticity of signatures on documents and acts and the compliance of these documents and acts with the laws of the state where the consulate is located.

What is the difference between apostille and legalization?

Official documents issued by all states that are not members of the Hague Convention of October 5, 1961 “Abolishing the requirement for legalization of foreign official documents” must be legalized.

Legalization is a longer process than an apostille and requires the document to be approved by the consulate of the foreign country in which it is intended to be used. A legalized document can be used only in the territory of the state that legalized it.

Compared to legalization, the issuance of an apostille is a one-step procedure, which involves the approval of the document by only one authority, and that document can be presented in all countries that are members of the Hague Convention of October 5, 1961 “Abolishing the Requirement for Legalization of Foreign Official Documents.”

Which governmental body carries out legalization process?

For consular legalization of the original of the document, the document should be brought to the consular office of Ministry of Foreign Affairs.

In order to legalize a copy or translation of a document, first of all, the authenticity of the translator’s signature on its copy and translation is confirmed by a notary. In this document, the authenticity of the notary’s signature and the seal belonging to that notary office are confirmed by the Ministry of Justice. After that, the document is legalized in the consular office of the Ministry of Foreign Affairs and in the consular service of the state in our country that will be used on its territory.

How can we apply for legalization process?

Legalization can be carried out in relation to the original document or its translation.

The document can be submitted in the following manner:

  • Directly by the document owner;
  • By third parties.

If third parties represent you for this process you should give power of attorney to that person’s name. You can apply for legalization through ASAN services centers or notary offices as well.
