From 1 January 2026, private medical institutions in Azerbaijan must review their property tax calculations following amendments to the Tax Code. The updated rules provide a 75% exemption for the value of qualifying fixed assets used for medical purposes, while the remaining 25% is subject to property tax under the general rules.
For private clinics, hospitals and diagnostic centres, the main practical questions concern asset eligibility, accurate accounting records and the treatment of property tax notifications. This guide explains the amendment and the steps healthcare businesses should take.
Property Tax Changes for Private Medical Institutions in 2026
Under Article 199.4, read together with Article 199.4.4 of the Tax Code of Azerbaijan, the exemption applies to 75% of the value of qualifying fixed assets used for the purposes specified in the legislation, including medical activities.
- 75% exempt portion: the qualifying portion of the asset value benefits from property tax relief.
- 25% remaining portion: the balance is subject to property tax under the applicable general rules.
- Asset eligibility: the institution must establish that the relevant fixed assets meet the statutory use requirements.
- Effective date: the amended treatment applies from 1 January 2026.
The State Tax Service confirms this treatment in its 2026 Tax Code amendments FAQ, page 21. Private medical institutions should therefore avoid carrying forward earlier exemption assumptions without reviewing the new rules.
Which Fixed Assets May Qualify for the Exemption?
The legislation refers to fixed assets used only for the purposes of the relevant sectors. A clinic’s medical activity does not automatically establish that every item on its balance sheet qualifies. The actual use of each asset should be examined and supported by records.
1. Medical and Diagnostic Equipment
Review equipment used in examinations, diagnosis and treatment. Asset records should identify the equipment, its location and its role in providing medical services. An equipment description alone may not fully establish its actual use.
2. Buildings and Treatment Areas
Review the use of buildings and individual areas before claiming relief. Do not assume that an entire property qualifies solely because a medical institution occupies it.
3. Administrative and Mixed-Use Assets
Office equipment, administrative property and assets used for several activities require separate assessment. Where an asset has mixed uses, the statutory exclusive-use requirement should be considered before applying the exemption.
These are practical review categories rather than a statutory list of automatically qualifying assets. Our accounting services in Azerbaijan can assist with fixed asset records, depreciation and supporting documentation.
How the 75% Property Tax Exemption Works
Assume that the value of qualifying medical-purpose fixed assets, determined under the applicable property tax valuation rules, is AZN 400,000. The exemption calculation would be:
- Qualifying asset value: AZN 400,000
- Exempt portion — 75%: AZN 300,000
- Remaining portion — 25%: AZN 100,000
Important: AZN 100,000 represents the remaining value subject to the applicable tax calculation, not the tax payable. This illustration assumes that eligibility and valuation have already been established and excludes other assets or adjustments.
What to Do After Receiving a Property Tax Notification
A property tax notification received in 2026 may reflect the amended exemption rules. The notification should be checked against the institution’s records before deciding whether a correction or challenge is necessary.
1. Review the Notification
Identify the tax period, stated amount, calculation basis, requested action and response deadline. Keep a record of when the document was received.
2. Reconcile the Accounting Records
Compare the tax authority’s figures with the fixed asset register, depreciation records, submitted returns and payment history. Check whether the calculation distinguishes qualifying assets from other property.
3. Check the Exemption Calculation
Confirm that the 75% relief has been applied to the appropriate asset value and that supporting records establish the required medical use.
4. Prepare a Documented Response
If a discrepancy exists, prepare a clear explanation supported by calculations and an asset schedule. A general statement that medical institutions are exempt is insufficient to explain the institution’s position under the amended rules.
5. Assess the Appropriate Legal Procedure
Depending on the document and circumstances, the next step may involve an explanation, corrected reporting, an administrative complaint or court proceedings. Review the applicable procedural deadlines promptly.

Documents to Prepare for a Property Tax Review
- The property tax notification and related correspondence
- The fixed asset register and relevant accounting schedules
- Acquisition documents and asset descriptions
- Depreciation and valuation calculations
- Records showing the location and actual use of the assets
- Relevant tax returns and payment documents
Legal Strategy and Ongoing Compliance
An effective response starts by identifying the precise issue: asset eligibility, valuation, the exemption calculation or the procedure followed. The accounting records and legal explanation should support the same position.
- Assign responsibility for maintaining the fixed asset register.
- Record changes in the use or location of equipment.
- Review the tax classification of newly acquired or repurposed assets.
- Retain supporting documents and copies of submitted correspondence.
- Include the revised property tax treatment in financial planning.
