Persons engaged in or planning to engage in business activities in the Republic of Azerbaijan:
Foreigners and stateless persons who conduct business in Azerbaijan are eligible to apply for a Temporary Residence Permit (TRP) as per Article 45 of the Migration Code of the Republic of Azerbaijan. The article specifies that only certain individuals, including the heads and deputies of companies with a foreign legal entity or individual as a founder, as well as the founders of those companies, heads of foreign company branches in Azerbaijan and their deputies, have the right to obtain a permit to reside in Azerbaijan on temporary bases. The right also extends to individuals who engage in entrepreneurial activities in Azerbaijan without the creation of a legal entity.
Persons who have invested in the economy of Azerbaijan or plan to do so:
Foreigners and stateless persons who invest at least AZN 500,000 (approx: USD 295 000) in Azerbaijan’s economy are eligible to obtain a Temporary Residence Permit (TRP). On mentioned base, the duration of the permit may be up to 3 years as per the Migration Code. The investment can be made in various ways, such as purchasing commercial real estate, shares in companies, securities, and more.
Family members of Temporary Residence Permit holders and close relatives of Azerbaijani citizens:
Family members of foreigners or stateless persons with a Temporary Residence Permit in Azerbaijan can also obtain a permit. This right applies to spouses, children under 18, and parents over 65.
The law also applies the right to obtain a Temporary Residence Permit for foreign close relatives of Azerbaijani citizens. The legislation specifically defines the circle of close relatives.
