Temporary Residence Permit (TRP or TRC) in Azerbaijan

A Temporary Residence Permit (TRC or TRP) is an official permit that gives foreigners and stateless persons the right to temporarily reside in Azerbaijan. A person with a Temporary Residence Permit (TRP or TRC) has the right to live in Azerbaijan during the period its validity. And also can enter the country without being required a visa. The State Migration Service of the Republic of Azerbaijan issues Temporary Residence Permits (TRP or TRC). A person granted a Temporary Residence Permit obtains a certificate (TRP or TRC Card) in this regard. A Temporary Residence Permit (TRP or TRC) in Azerbaijan is usually issued for a period of 1 year and its term is extended annually.

Each country has its legal requirements for the issuance of Temporary Residence Permit (TRP or TRC). These requirements may vary depending on the different reasons, such as the level of economic development, etc.

I. Who can obtain a Temporary Residence Permit (TRP or TRC) in Azerbaijan:

Under Article 45 of the Migration Code of the Republic of Azerbaijan, foreigners (stateless persons) obtain Temporary Residence Permit (TRP or TRC) in Azerbaijan on one of the following grounds:

  1. Close relatives of citizens of the Republic of Azerbaijan;
  2. Family members of persons with a Temporary Residence Permit in the Republic of Azerbaijan;
  3. Heads and their deputies of companies operating in the Republic of Azerbaijan (if the founder or at least one of the founders of which is a foreign juridical person or individual);
  4. Heads and their deputies of the branch and representative office of a foreign company in Azerbaijan;
  5. Foreigners or stateless persons engaged in individual entrepreneurship in the Republic of Azerbaijan.
  6. Foreigners and stateless persons who have real estate worth at least AZN 100,000 (approx. 60 000 USD) in Azerbaijan;
  7. Depositing at least AZN 100,000 (approx. 60 000 USD) to banks operating in the Republic of Azerbaijan based on a fixed-term deposit agreement;
  8. Investing at least AZN 500,000 (approx. 295 000 USD) in the country’s economy;
  9. Obtaining a work permit to engage in paid employment in the territory of the Republic of Azerbaijan by this Code;

II. The process of obtaining a Temporary Residence Permit (TRP or TRC) in Azerbaijan:

Foreigners and stateless persons can apply for a Temporary Residence Permit if one of the grounds listed above exists. In order to apply for a temporary residence permit, it is necessary to collect and submit relevant supporting documents. Applications are usually processed within 10-15 working days.

To obtain a Temporary Residence Permit, you must submit the following documents:

  • Notarized copies of documents that give you the basis for obtaining a temporary residence permit;
  • A medical certificate stating that you are not a carrier of communicable diseases defined by legislation;
  • Documents of the place of residence where you will be registered;
  • Two 3X4 size photographs;
  • Copy of the document granting the right to stay and live in the Republic of Azerbaijan;

III. Grounds for rejection of applications:

In some cases, we witness that the State Migration Service rejects applications. Besides, even in some cases, the existing ones are cancelled. So, in which cases are Temporary Residence Permits (TRPs) not issued (extended), or existing Temporary Residence Permits (TRPs) are being canceled? What can you do to avoid such situations?

Article 50 of the Migration Code of Azerbaijan includes cases that are grounds for refusal to issue a temporary residence permit. We would like to bring some of those cases to your attention for information:

  • When it can harm the national security of the Republic of Azerbaijan and the public order;
  • When they submit fraud documents or wrong information to obtain a permit for temporary residence in the Republic of Azerbaijan;
  • When their passports or another document for crossing the border expires less than in 3 months;
  • When they are carriers of a virus or any disease that is on the list of dangerous infectious diseases approved by the relevant executive authority etc.

The presence of one of the above-mentioned grounds is the basis for the refusal to issue (extend) Temporary Residence Permits (TRPs) to foreigners and stateless persons in the territory of the Republic of Azerbaijan and the cancellation of existing permits.
