Temporary Residence Permit (TRP) in Azerbaijan. Immigration Lawyers

Foreigners and stateless persons who plan to reside in Azerbaijan temporarily must obtain a temporary residence permit (TRP) in the territory of the Republic of Azerbaijan. The State Migration Service of the Republic of Azerbaijan issues Temporary Residence Permits (TRPs). When permission is issued, a foreigner (stateless person) is issued a certificate confirming that he/she has a residence permit in the Republic of Azerbaijan.

It must be noted that each state has its legal requirements for the issuance of TRPs. These requirements may vary depending on the different reasons, such as the level of economic development, etc.

I. Grounds for the issuance of a Temporary Residence Permit  (TRP) in the territory of the Republic of Azerbaijan:

Under Article 45 of the Migration Code of the Republic of Azerbaijan, foreigners (stateless persons) obtain Temporary Residence Permit (TRP) in the territory of the Republic of Azerbaijan on one of the following grounds:

  1. In case of close kinship relations with a citizen of the Republic of Azerbaijan;
  2. If there are family members of foreigners or stateless persons temporarily or permanently residing in the territory of the Republic of Azerbaijan;
  3. Holds the position of the head and his deputy of a company established in the Republic of Azerbaijan and the founder or at least one of the founders of which is a foreign juridical person or individual;
  4. Holds the position of the head of the branch and representative office of a foreign company in the Republic of Azerbaijan and his deputy;
  5. Engaged in entrepreneurial activity in the Republic of Azerbaijan;
  6. If he/she has real estate worth at least 100,000 manats (approx. 60 000 USD) in the territory of the Republic of Azerbaijan;
  7. Depositing at least 100,000 manats (approx. 60 000 USD) to banks operating in the Republic of Azerbaijan based on a fixed-term deposit agreement;
  8. Investing at least 500,000 manats (approx. 295 000 USD) in the country’s economy;
  9. Obtaining a work permit to engage in paid employment in the territory of the Republic of Azerbaijan by this Code;
  10. In the case of full-time education in higher and secondary special education institutions of the Republic of Azerbaijan, as well as in vocational and general education institutions.

The presence of any of the above grounds is the basis for obtaining a TRP for foreigners (stateless persons) in the territory of the Republic of Azerbaijan.

II. Grounds for refusal from the issuance of a Temporary Residence Permit (TRP) in Azerbaijan.

Sometimes we witness that Temporary Residence Permits (TRPs) are not issued. Besides, even in some cases, the existing ones are canceled. So, in what cases are Temporary Residence Permits (TRPs) not issued (extended), or existing Temporary Residence Permits (TRPs) are being canceled? What can you do to avoid such situations?

Article 50 of the Migration Code of the Republic of Azerbaijan specifically sets out the scope of the legal basis when the permit for temporary residence (TRP) in the territory of the Republic of Azerbaijan is not issued (extended) for foreigners and stateless persons:

  • When it can harm the national security of the Republic of Azerbaijan and the public order;
  • When they submit fraud documents or wrong information to obtain a permit for temporary residence in the Republic of Azerbaijan;
  • When they do not possess the identity documents or do not submit one or more of the documents specified in Article 44 of this Code;
  • When their passports or another document for crossing the border expires less than in 3 months;
  • When they are carriers of a virus or any disease that is on the list of dangerous infectious diseases approved by the relevant executive authority (except for those who are married to the citizens of the Republic of Azerbaijan);
  • When they were expelled from the Republic of Azerbaijan previously with restricting their entry to the country;
  • When the case that served as a basis for issuance of a permit for temporary residence in the territory of the Republic of Azerbaijan was eliminated and other cases provided for in this Code to obtain a temporary residence permit do not exist;
  • When they were outside the territory of the Republic of Azerbaijan for more than 90 days within 180 days;
  • When they left the territory of the Republic of Azerbaijan to reside in a foreign state permanently;
  • When their stay in the Republic of Azerbaijan is considered undesirable;
  • When a decision on their expulsion from the Republic of Azerbaijan was made;
  • When they violated the declared purpose of their visit to the Republic of Azerbaijan during their temporary residence in the territory of the Republic of Azerbaijan. 
  • When they failed to pay the administrative fine imposed for violation of rules of stay and residence of foreigners and stateless persons in the Republic of Azerbaijan.

The presence of one of the above-mentioned grounds is the basis for the refusal to issue (extend) Temporary Residence Permits (TRPs) to foreigners and stateless persons in the territory of the Republic of Azerbaijan and the cancellation of existing permits.
